April 8, 2013 Board Meeting Minutes

Meeting was called to order at 6:30 pm.

Present were: Dave Zeemont, President; Steve Bailey, Secretary; Bob Crowley, Treasurer; Larry Felhauer and Dave Wright, Directors at Large. Also present were William Webber, Design Control Chair and Maxine Webber.

Minutes from previous meeting were approved.

Bob Crowley presented the Treasurer's Report (see attached.) Bob stated that collections were coming along well with only a very few missing the first due date. A check was signed at the meeting for payment for the road sealing project and will be mailed. Nothing else out of the ordinary. The Treasurer's report was accepted by the Board.

Bob also stated that there was nothing to report concerning the Erosion Control Committee.

Steve Bailey reported that Carrie Gaddy, Landscaping Chair, was unable to attend the meeting but the only thing new to report was the replacement of a couple valves. This item was within her budget.

William Webber, Design Control, reported on several issues. The homeowner with the solar panels in the yard has returned and discussions will resume on mitigating the design violations. No word has been received recently concerning Lot 124. The County has placed a stop order on construction until some issues are cleared up.

Dave Wright, Gates Chair, reported that the SOS system is working properly. The backup battery on the Barcelona Gate has failed. This battery was recently installed so Allied (company providing gate service) is looking into the problem and will replace/repair it.

Larry Felhauer, Roads Committee, reported that the road resealing for 2013 has been completed with little or no complaints. The weather cooperated this year — no rain. There was some minor cleanup required. One neighbor mentioned that the overlap on Goldeneye was missed. Larry will check it out. (Larry reported on Tuesday that he had inspected Goldeneye and found no problem with the sealing. A spot on the island was too minor to call them back.) A question came up regarding how much money should be set aside for resealing in coming years. Larry did not have the figures with him but he will report back to the Board with the projected year the cycle will start over and how much needs to be set aside.

A couple complaints were lodged concerning cars parking overnight on the streets in violation of the CC&Rs. The main problem has been mitigated due to the resident moving. However, it was agreed that any future occurrences/complaints will be met with a letter to the property owner and a note placed on the windshield of the offending auto. If no results, a note will be placed on the windshield stating the car may be towed if not removed. It was noted that the Sub-Committee on Rules was currently meeting and was tackling the issue of parking. Their report will be presented to the CC&R/Bylaws Committee and the results will eventually be presented to all members at the Annual General Membership Meeting for a vote. Residents should note that daytime on-street parking is limited to not over 5 hours and must not occur on a regular basis. Any resident who has a regularly occurring guest parking on the street should arrange to have the car parked on their driveway. This is covered in the CC&Rs and the Board will begin enforcing this provision.

One Board member brought up the subject of barking dogs for a complaining neighbor. As a reminder, the CC&Rs state that dogs MUST be kept on a leash when not on the owners property. Also, dogs are not to be permitted to bark excessively outside in a way that would annoy the average person. The Board agreed that occasional barking, especially when someone is walking past a dog's property, would not constitute an annoyance. The intent of this rule is to prohibit dogs from barking for long periods of time, a sure sign of neglect. The best enforcement, if a dog is bothering you, is to notify the County Animal Control on your own.

Dave Zeemont mentioned that the Board of Directors should send a letter to the responsible parties concerning the Post Office refusal to allow package pickup and sign for registered letters, etc at the Fairacres Post Office. It was agreed that Dick Johnston would write the letter and Dave and Steve Bailey will edit it to make sure it says what the Association wants.

Permission was granted to Lot 107 to place decorative rocks on the road surface while distributing them on the property. The owner realizes that he is responsible for any damage to the street and curbs and that his contractor must put out traffic cones while the rocks are on the road.

The next meeting will be held on Monday, May 13, 2013 at 1236 Regency Court. Meeting was adjourned at 8 pm.
