April 11, 2011 Board Meeting Minutes

Meeting was called to order at 6:30 pm. Board Members present were Dave Zeemont, President; Steve Bailey, Secretary; Bob Crowley, Treasurer; Larry Felhauer and Kathy Mayer, Directors At Large.

Also present were Dave Wright, Gates Chair; William Webber, Design Control Chair; Barbara Rose Farber, Landscaping Chair; and Maxine Webber.

Minutes from the previous meeting were approved.

Bob Crowley presented the Treasurer's Report (attached.) Nothing out of the ordinary, however, he noted that 21 properties had failed to send in their 2011 annual assessments. $350 is currently overdue, while the Special Assessment of $300 will be due on or before June 30th. If you have overlooked sending in your dues, please do so now.

Bob Crowley also presented the Erosion Control report. They are in the process of finishing up the Barcelona Arroyo. Because the Erosion Control Committee has spent its budgeted $21,000 for the year, a motion passed to allow Bob to exceed his budget by up to $5,000, if needed. No other projects are planned for the remainder of the year, unless an emergency arises.

Dave Wright, Gates and Roads Chair, reported that the gates were working well and the SOS system had been tested and is working properly. They are beginning the process of obtaining bids for repairing and painting the gate structures, but would most likely wait until the road sealing project is finished. Dave and Larry Felhauer stated that bids are in the process now and they hope to begin Phase One of the road sealing project hopefully in May but perhaps in June. The scheduling for the sealing project will be a monumental undertaking because it will involve informing neighbors of when the sealing will take place and then working out a plan for affected neighbors to be able to enter and exit their properties. Most likely one side of each street will be done at a time, allowing the other side for traffic. Although not worked out yet, this may involve neighbors working together by parking in the "across the street" driveway while their side is drying. More information will be forthcoming, but we ask all residents (in Phase One) to be patient and try to work with the schedule; it will only be for a day or so at each location.

Barbara Rose Farber, Landscaping Chair, announced that she and Marco will be touring the area next month to determine what plants have died due to the extreme cold weather we had this year. A few plants that were obviously dead have been removed. Patience is the key word this year for anyone's plants. It was suggested that some plants not be replaced until next year because even nursery plants were affected and it makes no sense to buy damaged plants. It was also suggested that any dead trees be replaced with native trees that are both xeric and cold hardy.

In response to a complaint about weeds at a vacant house, the Board concluded that the weeds are on private property and some are on boundaries that are somewhat disputed. Furthermore, the weed problem is not a big problem, and could easily be rectified by going and pulling them out. Dave Zeemont agreed to contact the property owner and get permission to enter the property and for the owner to pay the expenses. The Board will monitor the progress.

The Board responded to an inquiry about a building on a property that may be in violation of the CC&Rs. After researching the matter, it was reported that the building in question was a child's playhouse that was cleverly constructed to look like a southwest building. The property owner had asked all of his neighbors if it would be a problem to construct, and everyone was in favor of it. He had previously asked the Design Control Committee, but because it had simply been in the form of a question and had not been put in writing, the Design Control Committee did not get back to him. The Board discussed the situation at great length (both this specific item and other potential problems) concerning the CC&Rs in regards to buildings. Strictly enforced, the CC&Rs could be read to prohibit any buildings, including doghouses and the like. The Board decided to handle this and any future inquiries on a case by case manner. If any neighbor is planning any type of building, it would be wise to contact the Design Control Committee first before proceeding. The Committee can either approve it (often), make a few suggestions to make it approvable, or decline it (rarely.) The Board approved the issuance of a variance for this playhouse, if the Design Control Committee so approves.

The Board approved the purchase of a few (as needed) signs to be placed in the vicinity of the Anthem Gate and mailboxes to help slow down traffic. Our sign source is the same one that does highway signs. We can put up advisories (Drive Slowly or Congested Area, etc) but we cannot put up traffic control signs such as Stop signs. Hopefully this will help out with the traffic hazard at the gate.

The next Board of Directors meeting will be held at Steve Bailey's home, 8160 Constitution Road at 6:30 pm May 9th.
