Annual Membership Meeting

October 5, 2008

A quorum was established and the meeting was called to order by President Dave Zeemont.  Board members present were Dave Zeemont, President; Mary Rita Chapman, Treasurer; Steve Bailey, Secretary; Larry Felhauer and Barbara Rose Farber, At Large.  General Membership present are attached to the written copy of these minutes.

Steve Bailey, Bylaws Committee Chair, explained the ballots and the procedures for voting on the By Law changes, and answered some questions from the floor.  After all questions were answered, Dave Zeemont announced that the voting shall begin.  After a reasonable time, all ballots were collected and taken for counting.

The changes to the Bylaws, as presented by the Committee, were passed by 43 yes to none against.  Three votes selected the line item voting method, choosing yes to some items and no to some items.  A simple majority was needed to pass.  On the second question regarding a change to the CC&Rs restating the rule on solar collectors, the measure passed 44 yes to 2 no.   A two-thirds vote was needed for passage.

Mary Rita Chapman, Treasurer, gave the Treasurer’s report (attached.)  She reported that all categories were substantially within budget.  The Board did redirect some funds from the Roads category to the Erosion/Drainage category to pay for the projects underway.  A question was asked about the telephone charge, to which Mary Rita explained that our gates are connected to phone lines for entry.  Another member questioned the use of our attorney.  Dave Zeemont explained that the majority of the attorney charges came from having to defend ourselves from claims of one of the lot owners (through his attorney.)  Also, the Bylaws were run by him because of the legal sensitivity of the rules.  Overall, we only contact our attorney when absolutely necessary.

It was suggested that Steve Bailey send out a copy of the Gate Etiquette to all members again so everyone will know how to use the gates when letting people in, etc.  This will be sent in a separate email.

Mary Rita mentioned that a Social Committee was very important and that we should be planning some kind of Holiday get together again this year.  A good many residents signed up to volunteer on the Social Committee.  Others volunteered for a similar group to welcome new residents to our community.  If you would like to serve on this Committee, or have some suggestions, please contact Mary Rita directly at [This email address is being protected from spambots. There was a complaint about the lack of a stop sign on (south bound) Anthem at our gate.  A resident had another near miss there because of poor visibility (trees, shrubs) and a speeding car coming toward her as she attempted to turn.  Dave Zeemont stated that he has repeatedly asked the County to install a stop sign but the County has refused until a certain number of cars begin using Anthem.  Or, presumably, enough accidents occur to warrant the sign.  Dave will once again plead with the County for some action.  Moving the mailboxes around 180 degrees which would allow cars to pull completely off the road may help, but we would still be challenged to cross Anthem to enter the gate.

Dave Zeemont announced that the proposed Barcelona Road extension has been delayed due to the County presenting plans for the Jackrabbit Interchange upgrade and the planned by pass from south of town to the interchange.  No date was given when the Barcellona Road would be started.  Steve Bailey, BR Road Ext Committee Chair, will look into the matter for exact information.

Kathy Mayer suggested that we start a website so that all residents could communicate with each other, etc.  She needs some volunteers with website savvy to help look into the possibility.  Steve Bailey volunteered to help with content but we still need some computer people.  Any one who can help please contact Kathy Mayer or Steve Bailey.

Dave Zeemont stated that the ongoing fight against the water rates increases is still going on.  He expects a decision to be made by November 1st, which is the deadline.  Dave thanked all the residents who sent checks to the PHPOA legal fund to help defray the costs of litigation.  The PHPOA is still in need of donations to help cover the high legal fees.  Donations of any amount are most welcome, with a suggestion of $50 (or more.)  Checks should be made out to the PHPOA legal fund and can be given to Dave Zeemont, Steve Bailey, dropped off in the PHPOA box at the Country Club or mailed to: PHPOA/Box 51/ Fairacres, NM 88033.

Dave and Mary Rita reported that we are continuing to contest the exorbitant water bills received earlier this summer at one of the drip system islands.  In a related matter, Dave passed around a petition that will be sent to our elected officials concerning our dispute over the pumping station with Picacho Hills Utility Company.  The company is benefitting from the station; however, we are still paying for the electricity.  If you want your name included on the petition, contact Dave at [This email address is being protected from spambots. Larry Felhauer mentioned that the dirtwork at the corner of Anthem and Barcelona was done free of cost by resident Kelly Dickson.  The entire membership wishes to thank Kelly for saving us lots of money and for continuing to offer his services to other erosion/drainage projects throughout our neighborhood.  Good job, Kelly!  The Board would also like to give a great big Thank You to Greg and Kathy Switzer and to Matthew and Carrie Gaddy for all their hard work on the landscaping.  Free is a very good price.  Thank you all for your hard work whether it be pulling weeds, grading dirt, serving on committees, calling on our phone tree or any number of other volunteer activities.  It all helps and that’s what neighborhoods are for.

Larry also announced that Mountain View Hospital is offering free flu shots on November 1st from 8 am until noon.  The flu shots will be given in a drive by so hang out your arm and let em shoot you as you drive by.  Actually, you stay in your car, fill out the paperwork, and when your turn comes, they will give you your shot while you are still in your car.

Suggestions for additional Bylaws changes were accepted.  It was suggested we add a Social Committee to the list of committees.  Also, we should revisit the annual yard sale issue at the next meeting.  Other ideas have been sent via email.

With no other business, Dave Zeemont declared the meeting adjourned.  Our next general membership meeting will be held sometime in January.  We don’t have an agenda yet, but we do know there will be elections for a couple Board Member postions held.  As part of the new Bylaws adopted at tonight’s meeting, a Nomination Committee has been formed.  If you would like to volunteer for this committee, just let me know.
